Terms & Agreements

Membership Agreement:

 

Studio’s schedule may be modified at the discretion of the studio from time to time for holidays, and other studio activities. The studio shall give prior notice of such modifications by general announcement.

 

The members recognize that regular class attendance is important for the member’s progress and understands that it is the member’s responsibility to attend the classes. It is further understood that the member is obligated to make payments whether or not the student attends classes. 

 

The member understands further that strict observation of the rules and regulations relative to training include the use of protective equipment required by the studio. This equipment will largely eliminate the possibility of accident or injury: however, the studio does not warranty the protective equipment. 

 

The member further agrees to waive any claim of damages against the studio and/or its principals or its instructors in any case resulting from the activity. The names of members or prospects and any photographs or motion pictures taken during the studio’s activities may be used for promotional purposes.

 

The parties agree that the costs for gloves, wraps, and other studio related activities are not covered by this document and remain the responsibility of the member.

 

The member has an option to cancel this agreement within 72 hours, however, no down payments or enrollment fees will be refunded. This agreement may be canceled for reasons of death by providing a death certificate. Should the member provide proof of a move and their new residence is located more than 25 miles from the studio, the member may be released from the remainder of his/her liabilities. 

 

This agreement is non-transferable without the express written consent of WORKOUT, INC. DBA Ultimate Kickboxing & Fitness.

Payment Agreement:

 

1 Year Agreement

The undersigned, jointly and severally, hereby promises to pay to WORKOUT INC. DBA Ultimate Kickboxing & Fitness the agreement package amount monthly fee, for a minimum period of 12 months. Upon completion of said period, agreement will continue on a month to month basis unless cancelled by completing the “Membership Cancellation Form” no later than 15 days prior to the eligible cancellation date. The “Membership Cancellation Form” must be submitted at the front desk and in person to ensure proper processing. 

If draft is declined on due date for any reason, the member will be invoiced a $15.00 fee to reinstate the Authorization Agreement for Recurring Drafts.

A new Authorization Agreement for Recurring Drafts will be sent to the member, which will need to be resubmitted immediately with the member’s new credit card information for future recurring drafts.

 

In the event the member has to change their form of payment for their recurring draft, Ultimate Kickboxing & Fitness must be notified 1 week prior to draft date, this notification must be done by emailing Monique@ultimatekick.com.

A new Authorization Agreement for Recurring Drafts will be sent to the member, which will need to be resubmitted immediately with the member’s new credit card information for future recurring drafts.

 

If any installment of this Agreement is not paid at the time and place specified herein, the entire balance hereunder shall become due and payable forthwith at the election of the holder of the Agreement. The undersigned all sureties, endorsers and guarantors hereof, hereby jointly and severally waive demand of presentment for payment, notice of dishonor, protest and notice of protest, and hereby agree to pay, upon the default of any payment hereof, reasonable expenses of the holder of this Agreement in enforcing its collection. Billing and recurring charges are handled by Ultimate Kickboxing & Fitness utilizing WIX Pricing Plan.

Month to Month

By purchasing the Month to Month Agreement you are agreeing that Ultimate Kickboxing & Fitness will charge you a monthly fee until cancelled by you. Once you are charged for the month this is non-refundable.
